Tasmania Cross-Border Wills · Assets in China & Australia

If you live in Tasmania but hold property, bank accounts or shares in mainland China or Hong Kong, a single Australian will is rarely enough. Sun Lawyers designs a coordinated estate plan — often a Tasmanian will plus a separate Chinese will — so your family avoids years of parallel probate applications after you pass.

What we do

Coordinated Two-Jurisdiction Wills

A Tasmanian will covering Australian assets, drafted so it does not accidentally revoke or conflict with a separate Chinese will covering mainland or Hong Kong assets.

Chinese Real Estate & Company Shares

Advice on how mainland real estate, bank deposits and limited-company shares pass under Chinese succession law, and what needs to be in place before the estate is opened.

Testamentary Trusts

Testamentary trusts to protect minor children, adult children with matrimonial risk, or beneficiaries who are still on Chinese passports.

Probate & Foreign Grants

Applying for a grant of probate in Tasmania and, where needed, resealing a Hong Kong grant or coordinating a Chinese notarised succession certificate.

Frequently asked questions

One will or two — which is better for China + Australia assets?

For most families with meaningful mainland assets, two coordinated wills is faster and cheaper for the family. We advise case-by-case after reviewing the asset list.

My will was made in China years ago — is it valid in Tasmania?

It may be recognised for movable assets but often causes delay and cost. Making a fresh Tasmanian will for Australian assets is usually the cleaner option.

Do you handle Hong Kong estates?

We work with a Hong Kong solicitor for the HK grant and reseal it in Tasmania where needed, so the family has one point of contact in Chinese.

How long does cross-border estate planning take?

Usually two to four weeks from first meeting to signed documents. Complex trusts or coordination with a mainland lawyer may take longer.
