Frequently asked questions

Is property in China counted in an Australian property settlement?

Generally yes. The court considers the worldwide asset pool. Enforcing orders over an overseas asset is a separate practical question, and the usual solution is to adjust the division of Australian assets to compensate.

Do we have to go to court?

Most matters resolve without a hearing. Parenting disputes generally require a family dispute resolution certificate before filing, and financial matters are usually settled by negotiation or mediation and then formalised as consent orders.

My spouse says I get nothing because the house is in their name. True?

No. Legal title is only one factor. The court looks at financial and non-financial contributions, including homemaking and parenting, and at each party's future needs. Registered ownership does not decide the split.

I am worried my child will be taken to China. Can that be stopped?

There are urgent options, including orders restraining removal and placing the child on the airport watch list. These applications are time critical — contact us the same day you become concerned rather than waiting.
