Frequently asked questions

Is a will I made in China valid in Australia?

It may be recognised, but recognition and practical usability are different things. Australian banks, registries and the court often need a NSW-compliant will or additional evidence. Where assets sit in both countries, separate wills prepared to work together are usually cleaner.

What happens if I die without a will in NSW?

The intestacy rules decide who receives your estate, in a fixed order that ignores your intentions. Someone must apply for letters of administration, which takes longer and costs more than probate on a valid will.

Can my child in China inherit my Sydney property?

Yes, a beneficiary does not need to be an Australian resident. The practical issues are identity evidence, notarised and translated documents, foreign purchaser duty if the property is later transferred, and tax treatment, all of which we plan for in the will itself.

Someone is contesting my parent's will. What now?
